The Regulation on the type of financial guarantees and equivalent insurance ensuring the performance of waste management activities (Official Gazette of the Republic of Serbia, No. 103/23) stipulates that a financial guarantee or equivalent insurance shall be submitted to the competent authority in the procedure for submitting an application for issuing a permit for the collection and transport, treatment, storage, reuse, disposal of waste and cross-border movement of waste, or for entry in the Register of Traders or Intermediaries in Waste Management. In the event that the applicant decides to submit a financial guarantee, when submitting an application to the competent authority, it is sufficient to submit proof that he has contacted the bank with a request for issuing a bank guarantee.
After the competent authority for issuing the permit determines that the applicant meets all other conditions for its issuance, it will submit a notification to the selected bank that the applicant meets the conditions for obtaining permits, and that the bank may issue a bank guarantee. Only after the applicant submits the bank guarantee to the competent authority, the competent authority will issue the requested permit.
This Regulation (Official Gazette of the Republic of Serbia, No. 103/23) Article 7, paragraph 9, stipulates that the Minister shall publish the harmonized amounts of financial guarantees.
